PLEASE READ CAREFULLY BEFORE REGISTERING. THIS IS A LEGALLY BINDING DOCUMENT.
In consideration of my participation in Monday Manna at Coconut Island (the “Event”), hosted by CBMC Inc. (the “Organization”), I agree to the following:
1. Assumption of Risk
I acknowledge that my participation in this Event is voluntary, and I understand that inherent risks may be involved, including but not limited to physical injuries, accidents, or unforeseen incidents. I accept full responsibility for any risks of injury or damage resulting from my participation, whether caused by my own actions or the negligence of others.
2. Release of Liability
I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, discharge, and hold harmless CBMC, its officers, employees, volunteers, and agents (collectively, the “Releasees”) from any and all liability, claims, demands, or causes of action, whether known or unknown, arising out of or related to any injury, loss, or damage to my person or property, that may occur as a result of my participation in the Event.
3. Medical Treatment
I understand that CBMC does not provide participants medical, accident, or health insurance. I consent to any emergency medical treatment deemed necessary and acknowledge that I am solely responsible for any costs related to such treatment. I agree to indemnify and hold harmless the Releasees for any costs or damages arising from any injury or medical treatment received.
4. Indemnification
I agree to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the Event and to reimburse them for any such expenses incurred.
5. Media Release
Without compensation or additional consent, I grant permission to CBMC Inc. to photograph, film, or record my participation in the Event for use in promotional materials, social media, and other media outlets.
6. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of Hawai’i, without giving effect to any choice of law or conflict of law rules.
By registering for the event, I acknowledge that I have read and fully understand this waiver and release of liability and that I voluntarily agree to its terms. I understand that by registering for the event, I am giving up certain legal rights, including the right to sue.
